Another success for family unity - Decision by Administrative Court Berlin
On 15th March, the Administrative Court Berlin obliged the German Asylum Service (BAMF), to take charge of the asylum procedures of three Syrian applicants who arrived in Greece in 2017. The family - a married couple and their adult daughter - will be reunited with their minor son and brother in Germany.
This is the second success of Equal Right`s aim to challenge Germany`s rigid practice regarding family reunions from Greece in court.
The court once more decided, that the strict deadline system in the Dublin procedure cannot be utilized by receiving member states in order to prevent family reunions. The court further followed our application to include the adult daughter in the family reunification due to the special humanitarian circumstances of the individual case.
