Decision by Administrative Court Münster - A great success for family unity in one of our cases!
On 21st December 2018, Administrative Court Münster obliged Germany to accept the family reunion of an unaccompanied minor to his brother in Germany under the Dublin Regulation III. Equal Rights has litigated the case together with our cooperation lawyer Christopher Wohnig.
The minor arrived in Greece already in 2016. The Greek Asylum Service did not send the take charge request to Germany in time, Germany rejected the family reunion several times.
The Administrative Court Münster made clear: family unity and best interest of the child have priority over deadlines.
We are glad about this ruling and hope that other courts will follow this interpretation of the Regulation.
